Transportation

Our staff is experienced in all aspects of first party and third party transportation claims, including Physical Damage, Motor Truck Cargo and Liability. All appraisals are reviewed to verify repair costs. Total loss evaluations are negotiated and settled directly with insureds, claimants and attorneys. Cargo claims are very specialized and require an understanding of Carmack, as well as, exceptions and contracts of carriage to determine the truckers’ legal obligations for proper review and settlements.   Our staff understands the importance of mitigating all losses and resolving claims as soon as possible. Our efficiency reduces the loss amount and related charges. 

Casualty

Our casualty adjusters are experienced in handling General Liability, Bodily Injury, Property Damage, Completed Operations, Product Liability and Litigation Management. 

Automobile

We are experienced with personal and commercial automobile lines of business. We distinguish the coverage and the liability issues, which are supported by a complete investigation, including witness statements, scene photographs, collision and property damage.

Litigation Management

Our firm manages litigation involving insurance liability defense, negotiation and settlement of claims, and matters of disputed coverage. We assist our clients in reducing their loss adjustment expenses by proactively evaluating claims to confirm coverage, investigate the loss, assess risk of exposure, and the potential for early claim resolution whether by negotiated settlement or technical legal disposition such as Summary Judgment. We actively manage defense counsel to help formulate legal defense strategies, determine necessity of proposed defense activities, and review defense counsel’s invoices to determine appropriateness of charges. When necessary and with the client’s authorization, we will proactively engage defense counsel pre-suit to review and advise on complicated claims involving challenging legal or coverage issues. Along the same lines, we will engage medical experts to review claims involving serious injuries or doubtful medical claims. Our staff is encouraged to engage in settlement negotiations directly with Plaintiff’s Counsel and will, if necessary, attend mediation and/or trial. We provide timely, comprehensive reports to our clients addressing all material issues. We believe our active monitoring and engagement with each claim file ensures our clients receive the most cost effective defense services.

Program Management

Our dedicated staff provides Third Party Administration to insurance carriers, reinsurers and Certain Underwriters at Lloyd’s, London and Self-Insured Programs and Risk Retention Groups. We understand the need to efficiently manage a program, while controlling costs. Our administration staff pays careful attention to the bordereaux data to make certain of accuracy. It is important to us that our clients are given a clear picture of the progress or exposures in their program. Our financial administration staff provides bordereaux and Trust Fund management services. The bordereaux is produced monthly using various formats to transmit information to our clients. Midway takes great measures to maintain the accuracy and integrity of all trust accounts using proper reconciliation procedures.

Investigation & Appraisals

Our professional claims staff is committed to providing services on a limited or full assignment basis. Our staff is available to provide tractor/trailer and heavy equipment appraisals and welcome any opportunity to represent your interests in the investigation of a loss, negotiate a settlement or attend mediation. Our staff is trained to recognize any potential coverage issues before, during and after the investigation process. Our staff negotiates and issues settlements directly with the insureds, claimants or attorneys. 

Salvage

In the event of a Total Loss, our staff is equipped to obtain and secure several salvage bids in order to provide the best possible salvage recovery. We manage the full salvage recovery and title transfer process.
